Various Local and International Standards are applicable in terms of a number of pieces of legislation. For the purposes of this document we have limited them to only two.
1. Act 85 of 1993 [Occupational Health and Safety Act] Section 44
2. Act 5 of 2008 [National Regulator for Compulsory Specifications Act] Section 13

Where a standard has been incorporated in terms of the NRCS Act, it is not required to be again incorporated in terms of other legislation.
All applicable incorporated standards therefore in terms of the NRCS Act are deemed to be incorporated in terms of the OHS Act.
In terms of OHS Act Section 44(3), every incorporated standard becomes a Regulation and therefore part of legislation. Prosecution may be implemented for not adhering to them.
In terms of General Administrative Regulation 4, a copy of the OHS Act may be required to be available at a workplace.
Note. As the OHS Act includes all applicable Regulations, and all Incorporated Standards, all such applicable Standards themselves become Regulations and so all applicable Standards MUST also be available at the workplace.

This page only includes Standards incorporated in terms of the OHS Act at this stage. It will be updated with relevant NRCS Act Standards in due course.
